HUD ELIGIBILITY: CITIZENSHIP AND IMMIGRATION COMPLIANCE

HUD assisted housing programs require owners and agents to verify the citizenship or eligible immigration status of individuals receiving housing assistance. Failure to properly collect declarations, verify documentation, and follow HUD notification requirements can lead to compliance findings and improper assistance determinations.

This session reviews the citizenship and immigration status requirements outlined in HUD Handbook 4350.3 Chapter 3 Paragraph 3.12, including the documentation and verification requirements that owners and agents must follow when determining eligibility for assistance. Participants will review how citizenship status must be evaluated at move in, during recertifications, and when household composition changes.

The program will also examine the documentation that must be collected from citizens and noncitizens, the use of the Systematic Alien Verification for Entitlements system, and the procedures owners must follow when immigration documentation is missing, unavailable, or pending verification.

In addition, the session will explore HUD requirements related to documentation deadlines, written notices, and prorated assistance for mixed citizenship households. Practical examples will help participants understand how to document tenant files, verify immigration status, and ensure compliance with HUD program requirements.
